How big is the Texas market for merchant cash advances?
Texas has more small businesses than any state except California. The SBA Office of Advocacy's 2025 Small Business Profile, built on 2022 Census data, counts 3,517,343 small businesses in Texas, 99.8% of all firms in the state. They employ 5.1 million people, or 44.4% of Texas employees.
The base keeps growing. Between March 2023 and March 2024, 86,385 Texas establishments opened and 78,648 closed, a net gain of 7,737. Small businesses accounted for 84.0% of the state's net new jobs in that window. The same profile notes that Texas small business employment grew 41.8% between 1998 and 2022, faster than the national rate.
Bank credit does not reach all of them. Reporting banks issued $8.6 billion in new loans to Texas businesses with revenues of $1 million or less in 2023. Spread across millions of firms, that leaves a large group of owners who need capital faster than a bank file moves, or who do not fit a bank's box at all. That gap is where a merchant cash advance, a purchase of a share of future receivables rather than a loan, gets considered.
Where the merchants sit matters for your order. The state's demand clusters in five areas:
- Houston and the Gulf Coast: energy services, petrochemical contractors, the port economy, restaurants and a huge trades sector.
- Dallas-Fort Worth: logistics, distribution, franchise retail, staffing and professional services.
- The I-35 corridor: Austin's construction and tech services boom and San Antonio's mix of military contracting, healthcare and hospitality.
- West Texas: Midland, Odessa and the Permian Basin oilfield service economy, plus El Paso's cross-border trade.
- South Texas and the border: McAllen, Brownsville, Laredo and Corpus Christi, with trucking, produce, retail and family-run service businesses.
Which Texas industries generate the most MCA demand?
Construction, trucking, oilfield services, restaurants and healthcare practices produce the most Texas merchant cash advance inquiries, and the SBA counts back that up. These sectors share one trait: money goes out well before it comes back in.
| Industry | Texas small businesses (SBA 2025) | Why owners ask for an advance |
|---|---|---|
| Construction | 428,901 | Materials, payroll and equipment are paid weeks before a general contractor or homeowner pays the draw. |
| Transportation and warehousing | 415,445 | Owner-operators and small fleets carry fuel, insurance and repair costs while freight brokers and shippers often pay on 30-day or longer terms. |
| Health care and social assistance | 259,406 | Clinics and home health agencies wait on insurance and Medicaid reimbursement. |
| Retail trade | 264,992 | Inventory buys ahead of back-to-school, holiday and border shopping peaks. |
| Accommodation and food services | 124,699 | Card-heavy revenue, thin margins and frequent equipment repairs. |
| Mining, quarrying, and oil and gas | 35,955 | Crews and service firms scale up or down with rig activity and operator payment cycles. |
Energy deserves its own line. The U.S. Energy Information Administration reports that the Permian region of West Texas and southeastern New Mexico produced 48% of U.S. crude oil in 2025. The small firms around that output, water haulers, hotshot trucking, welding shops, equipment rental yards, man camps and the restaurants that feed crews, see revenue swing with drilling activity. When activity jumps, they need cash to add trucks and people. When it drops, they need a cushion while invoices age.
Texas cash flow also follows the weather. Atlantic hurricane season runs June through November and can shut Gulf Coast businesses for days, then flood contractors with repair work they must finance up front. Summer heat pushes roofing and concrete crews to early starts and can slow outdoor work. Retail along the border tracks shopping traffic from Mexico, and agricultural suppliers in the Panhandle and Rio Grande Valley follow planting and harvest. What does Texas HB 700 mean for MCA funders and brokers?
Texas now regulates sales-based financing, including most merchant cash advances, under HB 700, which added Chapter 398 to the Texas Finance Code. The law was signed in June 2025. This is a plain-English summary as of 2026, not legal advice: confirm how it applies to your shop with Texas counsel.
| Provision | What it covers, in general terms |
|---|---|
| Scope | Sales-based financing: transactions repaid as a percentage of sales or revenue, including fixed-payment deals that reconcile to actual receipts. |
| Disclosures | For offers under $1 million, providers disclose items such as the total financing amount, disbursement amount, finance charge, total repayment, estimated term and payments, fees, collateral, and whether a broker is paid and how much. Effective September 1, 2025. |
| Registration | Providers and brokers register with the Office of Consumer Credit Commissioner (OCCC), through NMLS, by December 31, 2026, then renew annually. The registration duty has no $1 million cap. |
| Automatic debits | Providers and brokers may not set up automatic debits of a merchant's deposit account unless they hold a perfected, first-priority security interest in that account. Effective September 1, 2025. |
| Rules | The OCCC's final implementing rule took effect July 9, 2026. |
| Exemptions | Banks, credit unions and their affiliates, real-estate-secured deals and several other categories. There is no small-volume exemption. |
The automatic-debit rule gets the most attention because daily or weekly ACH remittance has been standard in the MCA industry. Funders active in Texas are reviewing their remittance structures, lien positions and contracts with counsel. ISOs and brokers are covered too: if you broker Texas deals, plan for your own registration, not just your funder's.
Outreach rules matter as much as product rules. Senate Bill 140, effective September 1, 2025, expanded the Texas Telephone Solicitation Act to cover marketing text messages. Whether it reaches your business-to-business follow-up depends on its exemptions, so ask counsel before you text Texas merchants at scale. The federal Telephone Consumer Protection Act (TCPA) still applies to calls and texts. LoanLeads.io captures TCPA consent on every lead; our TCPA consent and privacy page explains how.
How should you set up a Texas MCA lead campaign?
Start narrower than the state. Texas is big enough that a statewide, any-industry order spreads your reps across merchants you cannot fund. Build the campaign from the filters LoanLeads.io offers, then widen once you see which segment converts.
- Revenue floor. Set monthly revenue to match your smallest real deal. Many Texas funders start around $15,000 to $20,000 a month; trucking and construction files often show higher gross but lumpier deposits, so read bank statements before you raise the bar.
- Time in business. Six to twelve months is a common minimum. Texas forms a lot of new firms each year, so a stricter floor screens out many startups that are not yet fundable.
- Industries. Pick the two or three sectors your underwriters like. A funder with oilfield experience can target Midland and Odessa; a shop that prefers restaurants and retail can lean on Houston, San Antonio and the Valley.
- Geography. Geography is one of the campaign filters. Tell us which metros or regions to weight, such as DFW and Houston only, when you scope the order.
- Credit and amount. Match the credit range and requested advance to your product. A $10,000 request and a $250,000 request need different reps and different paper.
Calling windows. Houston, Dallas, Austin and San Antonio run on Central Time. El Paso and Hudspeth counties run on Mountain Time. If your floor is on the East Coast, a 9 a.m. Eastern start reaches Texas owners at 8 a.m. Central, which is early for restaurant operators and fine for contractors already on site. Federal TCPA rules limit telephone solicitations to between 8 a.m. and 9 p.m. in the called party's local time; build your dialer around the merchant's clock, not yours.
Delivery. Real-time leads post straight to your CRM by API or webhook, or to your inbox. In a market this size, your speed to the first call usually matters more than anything else you control, so route every new lead to a rep the moment it lands.
Real-time, aged or live transfer: which mix fits Texas?
Most Texas buyers do best with a blend: real-time leads for active pursuit, aged leads for volume at a lower cost per record, and live transfers for closers who want a merchant already on the line.
| Lead type | Best Texas use | Team it fits |
|---|---|---|
| Real-time exclusive leads | DFW and Houston owners who applied minutes ago and are comparing offers. | Teams that can dial within five minutes, all day. |
| Aged MCA leads | Oilfield and construction owners whose cash need comes back on a cycle, and merchants who were declined or waited out a first offer. | Larger floors running steady outbound and email sequences. |
| Live transfers | Closers who want a qualified Texas merchant transferred live, without dialing. | Small teams with strong closers and limited dial time. |
Aged leads earn a closer look in Texas because so much of the economy runs on cycles. A crew owner who did not need money in a slow quarter may need it badly when a new contract or rig program starts. One LoanLeads.io client, an MCA funder named Edward, funded five deals from a single aged-lead order, including a $600,000 deal and a $52,000 deal, for just shy of $1 million funded. In his words: "Yeah, I'm really impressed with the aged." Results vary by buyer, offer and follow-up, and no lead source can promise funded deals.
A sensible first order: a small real-time test in one or two metros, plus an aged batch in your best industry. Compare cost per funded deal after 30 days, then scale the winner. Our guide to buying MCA leads walks through that test, and many buyers pair a Texas order with campaigns in neighboring states.

Buyers who came back for more
Two real LoanLeads.io buyers, in their own words.
“Yeah, I'm really impressed with the aged.”
“My team is very happy with your leads. So that's why I want to personally call and inform you that. We'll do the same mix, 50-50, but we'll just double the volume. I'm happy. My team is happy. They don't complain about leads.”
Questions buyers ask
Are merchant cash advances legal in Texas?
Yes, merchant cash advances are offered in Texas, but as of 2026 they are regulated as sales-based financing under HB 700. Providers and brokers must give disclosures on offers under $1 million, register with the OCCC by December 31, 2026, and follow limits on automatic account debits. Confirm how the law applies to your contracts and remittance structure with Texas counsel.
Do ISOs and brokers have to register under HB 700?
HB 700 requires both sales-based financing providers and brokers to register with the Texas Office of Consumer Credit Commissioner, through NMLS, by December 31, 2026, and to renew each year. Brokers are also covered by the automatic-debit restriction. Exemptions exist for banks, credit unions and certain other categories, so check your status with counsel.
Which Texas cities produce the most MCA leads?
Volume follows population and business density, so Houston, Dallas-Fort Worth, San Antonio and Austin produce the most Texas inquiries. El Paso, the Rio Grande Valley, Corpus Christi and Midland-Odessa add strong pockets in trucking, retail and oilfield services. You can weight the metros you want when you scope a LoanLeads.io campaign.
What revenue minimum should I set for Texas MCA leads?
Set the floor at the smallest deal your underwriters will actually fund. Many funders start between $15,000 and $20,000 in monthly revenue. Texas trucking and construction merchants often show strong gross deposits with uneven timing, so review statements before you raise the floor and cut out good files.
What time zone should I call Texas merchants in?
Call most Texas merchants on Central Time. El Paso and Hudspeth County use Mountain Time, one hour behind. Under the TCPA, telephone solicitations are limited to 8 a.m. through 9 p.m. at the merchant's location, so set your dialer by the merchant's area, not your office clock.
Does the Texas texting law affect MCA lead follow-up?
It might. Senate Bill 140 expanded the Texas Telephone Solicitation Act to cover marketing text messages starting September 1, 2025, with registration duties for covered sellers and several exemptions. Whether your business-to-business texts are covered is a legal question, so review your SMS program with counsel before texting Texas merchants at volume.
Are aged MCA leads worth buying in Texas?
They can be. Much of Texas business runs on cycles tied to oil activity, construction draws and storms, so an owner who passed months ago may need capital now. Aged leads cost less per record and suit steady outbound and email follow-up. Start with a test batch and measure cost per funded deal.
Is a merchant cash advance a loan in Texas?
A merchant cash advance is structured as a purchase of a share of a business's future receivables, not a loan. HB 700 treats it as sales-based financing and requires disclosures and registration, and it removed the account-purchase treatment some providers relied on. How a court views a specific contract depends on its terms, so get legal review.
