Industries that drive MCA demand:
Since August 1, 2023, providers and brokers must give standardized cost disclosures, including an estimated APR, on sales-based financing offers of $2.5 million or less. A 2019 amendment to CPLR 3218 also stopped confessions of judgment from being filed in New York against out-of-state merchants.

How big is the New York market for merchant cash advance leads?
New York is one of the deepest MCA markets in the country: the SBA Office of Advocacy counts 2.4 million small businesses in the state, 99.8 percent of all New York firms, employing 3.9 million people, or 46.6 percent of the private workforce. Those figures come from the 2025 Small Business Profile, which uses 2022 Census data.
Most of that volume sits in one metro. Advocacy's 2025 metro profiles put the New York-Newark-Jersey City area at 2.6 million small businesses, the most of any US metro, with 4.1 million small-business employees. That metro crosses into New Jersey and Pennsylvania, so if you only fund New York merchants, filter by state rather than by area code.
The churn is constant. Between March 2023 and March 2024, small businesses accounted for 62,612 New York establishment openings and 59,915 closings. Each opening is a future working-capital request, and each owner who is fighting off a closing is a cash-flow conversation that a bank rarely wants to have.
| Region | Merchant profile you will see | What to filter for |
|---|---|---|
| Five boroughs | Dense restaurant, retail, personal-service and delivery businesses, many with daily card volume | Revenue floor, industry, time in business |
| Long Island | Contractors, landscapers, auto shops and East End hospitality with a hard summer peak | Seasonal industries, higher advance amounts |
| Hudson Valley and Capital Region | Trades, medical and dental practices, tourism around the Catskills and Saratoga | Health care and construction |
| Western and Central NY | Buffalo, Rochester and Syracuse manufacturers, distributors, trucking and restaurants | Manufacturing, wholesale, trucking |
Which New York industries generate the most MCA demand?
Food service, construction and retail produce the steadiest New York MCA demand, because each runs on thin margins, daily receivables and costs that land before revenue does. The SBA data shows how much of each sector small firms carry.
- Restaurants and food service. Small accommodation and food businesses employ 537,380 New Yorkers, 73 percent of that sector's jobs. Rent, payroll and food costs are weekly, card sales are daily, and a broken walk-in cooler cannot wait for a bank decision. See the restaurant MCA lead breakdown for filters.
- Construction. Small firms hold 89.4 percent of New York construction employment. Contractors front materials and labor, then wait on draws and retainage, and upstate winters push exterior work into a short season.
- Retail. 174,805 small retailers, many in the city, carry inventory into the November and December peak and live on card volume the rest of the year.
- Transportation. The profile counts 315,172 small transportation and warehousing businesses, the vast majority without employees. Owner-operators and small fleets need fuel, insurance and repair money between broker payments.
- Health care and wholesale. 202,180 small health care businesses wait on insurance reimbursements, and wholesalers that supply the city's restaurants and stores carry receivables for 30 days or more.
Seasonality across the state
New York's calendar is uneven. The Hamptons, Montauk, the Catskills and the Adirondacks do most of their hospitality revenue between Memorial Day and Labor Day, so owners there look for capital in spring to staff and stock. Upstate contractors slow when snow arrives and ask for funds to cover payroll through the first quarter. City retail ramps toward the holidays and often asks for inventory money in September and October. Set your aged-lead pulls and campaign budgets to match those windows instead of spreading spend flat across twelve months.
What does New York law require on merchant cash advance offers?
New York has a commercial financing disclosure statute that reaches merchant cash advances, and it is one of the most detailed in the country. Here is the plain-English version as of 2026. It is not legal advice, so confirm current requirements with counsel before you send offers.
Commercial Finance Disclosure Law (CFDL)
The CFDL, Article 8 of the Financial Services Law, requires providers to give a standardized disclosure when they extend a specific offer of commercial financing of $2.5 million or less. Sales-based financing, the category that covers most merchant cash advances, is named in the rule alongside factoring, open-end and closed-end financing. The Department of Financial Services finalized its regulation in February 2023, and compliance became mandatory on August 1, 2023. Disclosures cover items such as the total amount funded, the finance charge, an estimated APR and the payment amounts. Brokers who solicit offers on a funder's behalf are part of the picture too, and civil penalties can reach $2,000 per violation or $10,000 per willful violation.
Confessions of judgment after 2019
For years, New York courts were a common venue for confessions of judgment against merchants who lived anywhere in the country. On August 30, 2019, an amendment to CPLR 3218 ended that practice for out-of-state debtors: a confession can now be filed only in the New York county where the defendant lived when it was signed, or lives when it is filed. If you fund merchants outside New York, a New York confession of judgment clause no longer does what it once did.
Enforcement climate
In January 2025 the New York Attorney General announced a $1.065 billion judgment and settlement with a group of MCA companies accused of collecting fixed daily amounts while calling the deals purchases of future revenue. In December 2025 the governor also signed the FAIR Business Practices Act, effective February 2026, which lets the Attorney General pursue unfair and abusive practices, not only deceptive ones, including in commercial dealings. The lesson for buyers: structure and disclose an MCA as what it is, a purchase of future receivables with a reconciliation right, and never pitch it to a New York merchant as a loan.
How should you set up a New York MCA lead order on LoanLeads.io?
Start narrow, measure, then widen. A New York order works best when the filters mirror the deals you actually fund, because the state is big enough that loose filters bury your closers in files they will decline.
- Set a revenue floor that matches your box. Many New York funders start at $15,000 to $20,000 in monthly deposits to keep city rents and stacking risk in check. ISOs with a wide panel of funders can go lower.
- Pick a time-in-business minimum. Six months is a common floor, twelve if your funders want a full seasonal cycle on the bank statements.
- Choose industries on purpose. Include restaurants, construction, retail and transportation if your panel takes them. Exclude anything your funders restrict.
- Use geography as a dial. Run the whole state, or test the five boroughs against Long Island and upstate as separate campaigns so you can compare cost per funded deal by region.
- Connect delivery before the first lead. Post leads straight into your CRM by API or webhook so the dialer fires the moment a merchant submits.
- Start with a test order. Check contact rate, submission rate and funded deals on your own numbers, then scale the campaigns that pay.
Calling is simple in one sense: all of New York is on Eastern Time. Work leads between 9 a.m. and 7 p.m., and treat restaurant owners differently, since 11 a.m. to 2 p.m. and the dinner rush are the worst times to reach them. Mid-afternoon usually works better. Our guide to buying MCA leads covers the order process step by step.
Real-time, aged or live transfer: which mix fits New York?
Most New York buyers do best with a blend: real-time leads for speed, aged leads for volume at a lower cost per record, and live transfers when they want the merchant already on the line.
| Lead type | Why it fits New York | Who it suits |
|---|---|---|
| Real-time exclusive | New York merchants hear from many shops. The first credible call after a submission usually wins the file. | Funders and ISOs with a dialer and staff ready during business hours |
| Aged leads | A merchant who was declined or went quiet months ago may now have six more months of deposits and a real need. | Teams with a disciplined follow-up cadence and a bigger list budget |
| Live transfers | The owner is already talking, which removes the hardest step in a crowded market. | Closers who convert on the first call and want fewer dials |
Do not write off aged data in a crowded state. Edward, an MCA funder who buys from LoanLeads.io, closed five deals off one aged-lead order. One was $600,000, another $52,000, and the total came to just shy of $1 million funded. On a recorded review call he put it simply:
"Yeah, I'm really impressed with the aged."
Results depend on your offer, your underwriting and your follow-up, so treat that as one buyer's experience, not a forecast.
How do you stand out when calling New York merchants?
Lead with clarity, not urgency. New York owners are among the most solicited in the country and many have a stacked position already, so the shop that explains cost and terms plainly tends to earn the second conversation.
- Ask about current positions early. Knowing about existing advances up front saves your underwriters a wasted file and helps you offer a consolidation or a smaller first position.
- Have the CFDL disclosure ready. When you present a specific offer, the disclosure is part of the offer. Merchants who compare offers side by side will notice who sends it promptly.
- Talk about the reconciliation right. Explaining that remittances follow receivables, and how to request an adjustment if sales drop, separates a true sales-based product from a disguised loan.
- Follow up on a schedule. Day one, day three, day seven and day fourteen touches, by phone and email within the consent the merchant gave, recover files that went cold.
For scripts, cadences and objection handling, read the MCA conversion playbook. If you are an ISO building a New York book, route each lead to the funder whose box it fits before the first call, not after.

Buyers who came back for more
Two real LoanLeads.io buyers, in their own words.
“Yeah, I'm really impressed with the aged.”
“My team is very happy with your leads. So that's why I want to personally call and inform you that. We'll do the same mix, 50-50, but we'll just double the volume. I'm happy. My team is happy. They don't complain about leads.”
Questions buyers ask
Can I buy MCA leads for just New York City?
Yes. You can set geography filters so a campaign covers only the five boroughs, or split the city, Long Island and upstate into separate campaigns. Splitting helps you compare cost per funded deal by region, since a Manhattan restaurant and a Rochester machine shop usually need different offers, funders and follow-up.
Does the New York Commercial Finance Disclosure Law apply to merchant cash advances?
As of 2026, the law covers sales-based financing, which includes most merchant cash advances, on offers of $2.5 million or less. Providers must give a standardized disclosure with items like the finance charge and an estimated APR when they present a specific offer. Confirm the current rules and any exemptions with counsel.
Can a funder still use a confession of judgment with a New York merchant?
The 2019 amendment to CPLR 3218 bars filing a confession in New York against a debtor who lived out of state when signing. Merchants who live in New York are treated differently, but enforcement climate and contract terms have shifted, so ask counsel before relying on any confession of judgment clause.
What time zone should I call New York MCA leads in?
All of New York is on Eastern Time, so one calling window covers every lead. Most teams dial from 9 a.m. to 7 p.m. and call real-time leads within minutes. For restaurant owners, mid-afternoon between lunch and dinner tends to be the easiest time to get them on the phone.
Are aged MCA leads worth buying in a saturated state like New York?
They can be. Aged leads cost less per record, and a merchant who was not ready months ago may now qualify. One LoanLeads.io funder, Edward, funded five deals from a single aged order, totaling just shy of $1 million. Your results depend on your offer and follow-up discipline.
What monthly revenue filter should I use for New York MCA leads?
Match the filter to the deals you fund. Many New York funders start around $15,000 to $20,000 in monthly deposits, while ISOs with broad funder panels can go lower. Test a narrow filter first, check funded deals against spend, then widen if the numbers hold.
Is a merchant cash advance a loan under New York law?
A properly structured MCA is a purchase of future receivables, not a loan, and New York courts look closely at whether the funder really bears the risk of lower sales. Features such as a working reconciliation clause and no fixed repayment term matter. Have counsel review your contracts.
How are New York MCA leads delivered?
Real-time leads post straight into your CRM through an API or webhook, or arrive by email, the moment a merchant submits. Aged leads are delivered as files that match your filters, and live transfers ring your closers while the merchant is still on the phone.
